The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 98 of 2020, dated 10.02.2020, instituted for the offences under Sections 363, 364 and 370 of the Indian Penal Code. The petitioner is alleged to have taken away the
Patna High Court CR. MISC. No.32314 of 2020(2) dt.08-02-2021 2/3 son of the informant and till the date of lodging of the F.I.R., the son of the informant had not returned.
Learned counsel for the petitioner has submitted that after the return of the victim, his statement under Section 164 Cr.P.C. has been recorded. It reveals that he was enticed to work as a cleaner in a bus which plied from Hajipur to Sonepur station. It has been alleged by the victim that the money which he earned was taken away by the petitioner.
Learned counsel for the petitioner has submitted that the victim boy is not so small that he could not have run away from the so-called captivity. The victim actually went out of his house of his own volition along with the petitioner but for some reason or the other, he has cooked up this false story.
Considering the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two
