The petitioner has been in custody since 16.05.2020 in connection with Rajpur P.S. Case No. 100/2020 registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act and 30(a) of the Bihar Excise (Amendment) Act, 2018. As per the prosecution case, one country made pistol, nine live cartridges and sixty-one pieces of 200 ml. wine has been recovered from the house of the petitioner. It is submitted that alleged recovery of wine was made from the motorcycle which was lying outside the house of the petitioner. It is further submitted that nothing has been recovered from the possession of the petitioner and the recovery of alleged articles are from the room of the house which is in joint possession of the other family members. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Buxar, in connection with Rajpur P.S. Case No. 100/2020.
