16/18 CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-12-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of the appropriate writ or a writ of certiorari or any other writs or order/orders commanding the respondent nos. 1 to 3 by setting aside the letter no. 1069 dated 9.7.2021 which contains the interim arrangement of the eligibility test for the employed and working Executive Assistants based on contract and it has been announced to be held on 31.7.2021 arranged by the Beltron an extraneous agency such notice creates havoc among the employed petitioners and it is violative to the Articles 16 and 21 of the Constitution of India. As per Service Code, the promotional benefits ought to be awarded but after more than 10 years of service, the respondents have played a discriminatory role to retrench the employed petitioners without any departmental proceedings.
(ii) For issuance of appropriate writ of certiorari to the respondents by setting aside the letter No. 488 dated 7.3.19 which contains the discriminatory pay scale to the Executive Assistants of Class-l having experience of below 5 years for Rs. 14658/-, Class-II, having experience of more than 5 years for Rs. 17458/- and class-III being pass out of the eligibility test
17/18 who get Rs. 18,564/- per month. These three categories of the Executive Assistants will create havoc among the working employees leading to violate the Article 14 of the constitution of India. (iii) For issuance of appropriate writ or a writ of mandamus to the respondents not to create difference in honorarium/salary from 2021 to the contractual appointed employees i.e. Executive Assistants. These employees may lead to unsatisfied preparation of the Public utility if they are made a tool for eligibility test by Beltron for increment. They will only think of preparation of eligibility test and the concept of government job will be unproductive. The respondents ought to regularize the Executive Assistants i.e. petitioners but they are making tools for re-appointment which may lead to nepotism and corruption in the society and day to day retrenchment may create flouting of Article 21 of the COI.
(iv) For issuance of appropriate writ in nature of certiorari or orders commanding the respondents to forbear from giving any effect of the letter No. 3/M-78/2005 Sa.Pra.2832, Patna dated 01.03.2021 regarding verification of the character and antecedents of the formerly selected and appointed Executive Assistants. The working employees apprehend that their ACR (Annual Confidential Report) may be made dark from any corner during verification."

After some arguments, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to approach the Respondents authorities for redressal of their aforesaid grievances. Liberty, so sought, is granted.
