JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Begusarai Town P.S. Case No. 526 of 2018, disclosing offences under Section 379 of the Indian Penal Code. Allegation against the petitioner is of committing theft of Scorpio vehicle.

Submission of learned counsel for the petitioner is that he is cousin brother of the informant and the whole allegation is false and concocted and earlier to that he has lodged a case against the informant. It has further been submitted that the finding of learned court below is that the petitioner has been seen committing theft of motorcycle in CCTV and further no such material is available in the case diary and the petitioner has no criminal antecedent.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks and on his surrender, the court below shall verify the case diary and if does not found involvement of the petitioner in the CCTV footage, the court below shall release the petitioner on bail to his own satisfaction. Till then, petitioner shall be released on provisional bail to his own satisfaction.
