JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Dharahra P.S. Case No. 02 of 2019, disclosing offences under Sections 302, 201 & 120B of IPC. Allegation as per written report is that the son of the informant was assaulted by co-accused Arvind Kumar Mandal and other they were threatened and thereafter, accused Arvind Kumar Mandal threw his son in the Well, leaving behind his motorcycle, fled away. It also appears that the informant and villagers reached there, the petitioner and other accused persons were trying to lift the dead body from the Well in order to dispose of the dead body.

Submission of the learned counsel for the petitioner is that even according to the F.I.R. there is no allegation of any assault or other overt act except he was disposed of the dead

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Munger, in connection with Dharahra P.S. Case No. 02 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
