The petitioner seeks bail in a case under Section 376 and of the Indian Penal Code.
The petitioner is alleged to have committed rape with a minor girl.
The prayer of petitioner for bail was earlier rejected by this court vide order dated 31.08.2015 passed in Cr. Misc. No. 39287 of 2015. A report was called for from the trial court about the stage of trial. The learned Additional Sessions Judge-VIII, Patna has reported that only I.O. is to be examined and the trial is likely to conclude within one month.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
Patna High Court Cr.Misc. No.1176 of 2016 (3) dt.29-06-2016 2/2 The trial court is directed to hold the trial on day to day basis and conclude the same within one month from the date of receipt/ production of a copy of this order.
