The petitioner is accused in connection with Begusarai Muffasil (Lakho) P.S. Case No. 424 of 2015 registered under Section 364(A) of the Indian Penal Code.

The accusation is of kidnapping of Shoeb Akhtar, son of the informant, on 24.10.2015, in the evening, in course of returning after collection of the money from the fruit seller. Learned counsel for the petitioner submits that on the basis of written report of informant, Md. Abdul Rajjak, regarding kidnapping of his son, Shoeb Akhtar, the present case was instituted, under Section 364(A) of the Indian Penal Code, against unknown and on the next day in the morning the victim was set

Patna High Court Cr.Misc. No.2463 of 2016 (4) dt.11-04-2016 free by the culprits inside the road, who reached at the police station and informed about the occurrence, which would appear from his statement recorded under Section 164 of the Cr.P.C. on 27.10.2015 (Annexure 2 to the application). It is further submitted that petitioner was apprehended by the police armed with country made pistol, regarding which, Begusarai Town P.S. Case No. 595 of 2015 was instituted against the petitioner and others and thereafter police also got recorded the confessional statement of the petitioner showing the involvement in the present case. Further submission is that while the petitioner is remanded in the present case on 30.10.2015 but he has not been put on T.I.Parade.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Muffasil (Lakho) P.S. Case No. 424 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
