Petitioners apprehend arrest in a case registered for offences punishable under Sections 353/307 of the Indian Penal Code.

It is alleged that about 150 unknown persons, in protest of killing of a shopkeeper, were engaged in raising slogan against the administration and when police tried to pacify they pelted stone injuring police men, they also set ablaze one ambulance.

Learned counsel for the petitioners submits that the petitioners are not concerned with the said incident and their

Patna High Court CR. MISC. No.33526 of 2019(2) dt.31-07-2019 2/2 names have come in this case on the statement of Chaukidar, though there is no specific allegation against them. The petitioners have got no criminal antecedent and have been roped in this case due to ulterior motive.

Considering the facts of the case, let the petitioners, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Vaishali at Hajipur in Jandaha Police Station Case No. 38 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioners.
