2. The petitioner is in custody since 29.09.2014 in connection with Koran Sarai P.S.Case No. 68 of 2014 for the offences alleged under Sections 25(1-b)a/26/35 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated and no recovery has been made from his conscious possession. Learned counsel for the petitioner raises some doubt with regard to the place of recovery as seems from the seizure list containing some cuttings. The petitioner has already suffered more than four months in jail custody.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner Kangresh Yadav @
Patna High Court Cr.Misc. No.48933 of 2014 (2) dt.20-02-2015 Umesh Singh be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Sri L.K.Mishra, learned Judicial Magistrate, Ist Class, Buxar, in Koran Sarai P.S. Case No. 68 of 2014 with condition that the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
