Petitioner is languishing in custody since 21.10.2015 in a case registered for the offences punishable under Sections 212, 216, 399, 402, 414 of the Indian Penal Code, 25(1-B)A, 26, 35 of the Arms Act and 20, 22 of the Narcotics Drugs and Psychotropic Substances Act. The prosecution case is that on information that the miscreants are preparing to commit dacoity, raid was laid, when several persons were arrested. From the possession of the petitioner one country made loaded pistol and two mobiles were recovered. It appears that petitioner is accused in four other cases also.
Considering the nature of recovery and criminal
Patna High Court Cr.Misc. No.3142 of 2016 (4) dt.16-02-2016 antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner in connection with Sadar P.S. Case No. 557 of 2015, pending in the court of learned Sessions Judgecum-Special Judge, Muzaffarpur. Accordingly, the prayer for bail is rejected. (Dinesh Kumar Singh, J) P.K./- U T
