The appellants seek pre-arrest bail in connection with Sahebganj P.S. Case No. 425 of 2018 registered under Sections 147, 148, 149, 354, 427, 323, 307, 302, 504, 506 of the Indian Penal Code and Section 3(i) (r) (s) (w) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Submission of learned counsel for the appellants is that the appellants have no criminal antecedent. They are innocent and have falsely been implicated in the present case. Further submission is that there is case and counter case

Having heard both sides and in the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the 11th Additional Sessions Judge-cumSpecial Judge, SC/ST Act, Muzaffarpur in connection with Sahebganj P.S. Case No. 425 of 2018, subject to the conditions as laid down under section 438(2) of Cr. P.C. Accordingly, the appeal is allowed and the impugned order is set aside.
