The petitioner apprehends his arrest in a case registered for the offence under Section 379 of the Indian Penal Code.

As per the F.I.R., petitioner alongwith his associates are alleged to have stolen the tractor of the informant. Petitioner is not named in the F.I.R. Name of the petitioner transpired in extra-judicial confession of co-accused Sarfe Alam. No stolen article has been recovered from the possession of the petitioner.

However, learned A.P.P. for the State opposed the prayer for anticipatory bail and submitted that petitioner has got criminal antecedent of similar nature.

Considering the aforesaid facts and circumstances, I
