JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 27-07-2015 in a case registered under Sections-304B/34 of the Indian Penal Code. The contention on behalf of the petitioner is that the informant lodged this case under misconception and when he learnt the real fact, he filed compromise petition before the court below.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail at least, at this stage and accordingly, his prayer for bail in connection with Muffasil P.S. Case No. 259
Patna High Court Cr.Misc. No.1258 of 2016 (4) dt.04-03-2016 of 2015 pending in the court of learned Chief Judicial Magistrate, Begusarai stands rejected.
However, learned Chief Judicial Magistrate, Begusarai is directed to commit the case of the petitioner to the court of Sessions in accordance with law within two weeks from the date of receipt/production of copy of this order and after that, learned Sessions Court shall expedite the trial of the petitioner and try to conclude the same as early as possible.
