2. The petitioner has prayed for bail in connection with Sasaram (Muffasil) P.S. Case No. 102 of 2026 registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S.,2023. The present application is filed under Sections 483 and 484 of the B.N.S.,2023.
3. The case of the prosecution, in short, is that altogether seven persons surrounded the son of the informant and killed him by assaulting with lathi, danda, iron rod and garasa.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has been falsely implicated in this

He also submits that the name of this petitioner is not there in the F.I.R, rather his name has surfaced on the basis of the confessional statement of her son, namely, Jibu Beg. Jibu Beg is a named accused in this case, and during the course of the investigation, he has given his confessional statement in which he has stated that the petitioner was also involved in the alleged occurrence. Learned counsel also submits that even from the confessional statement of the son of the petitioner, it is not clear as to what the role of the petitioner was. Though the petitioner is not named, her name has surfaced during the course of the investigation. No role is attributed to her even in the confessional statement of her son. He further submits that the petitioner is a lady who is aged about 70 years. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and she is languishing in judicial custody since 26.03.2026.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail
