The petitioner is languishing in custody since 31.12.2014 in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.

It is alleged that the petitioner dragged the deaf and dumb wife of the informant and attempted to establish forceful physical relationship.

It is submitted by learned counsel for the petitioner that for the occurrence of 20.08.2014 the FIR was registered on 02.09.2014. The wife of the petitioner filed Complaint Case No. 665 of 2014 on 25.08.2014 against the son of the informant making accusation under Sections 323, 354, 364 and

Patna High Court Cr.Misc. No.10946 of 2015 (02) dt.24-03-2015 2/2 376/34 of the IPC and as a retaliatory measure the present case has been lodged. There is no medical report of the victim on the record.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bikramganj (Rohtas) in connection with Dawath P.S. Case No. 99 of 2014.
