The case is registered under Section 304(B) IPC, in connection with P.S. Case No. 420 of 2021.

The prosecution story reads as follows :- The informant, Suresh Yadav stated that he solemnized the marriage of his daughter, Soni Kumari an year ago with Chandra Kishore Yadav (the petitioner herein). On 04.12.2021, the informant got information that Soni's family members have killed her by administering poison. The informant along with his family members rushed to her in laws place but no one was found there. The informant unsuccessfully

Patna High Court CR. MISC. No.33674 of 2022(2) dt.13-09-2022 2/2 made search to trace out his daughter Soni Kumari. Then the Banmankhi Police Station was informed. The Police too tried to find her out. The informant then came to know that she (Soni Kumari) has been taken to Araria or Purnia for treatment. After hectic search, he found his daughter Soni in dead condition on road. On seeing the informant and others, the accused persons fled away.

As per the post-mortem report, the sign of assault had been found on the person of the deceased. The petitioner being the husband of the deceased lady, his responsibility and/or failure to protect his wife cannot be overlooked. The bail application is accordingly rejected.
