JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded under section 164 of the Cr.P.C but she admitted in her statement that while she was being carried on the vehicle, the petitioner and one Runuk Jha, got down from the vehicle. The victim leveled the allegation of rape against the co-accused Paras Jha. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge 1st Saharsa in connection with Bihra P.S.Case No. 221 of 2014.
