Earlier prayer for bail of the petitioner was rejected by a coordinate bench of this court and this second bail petition has been filed on behalf of the petitioner on the ground that the petitioner is languishing in jail custody since 17.12.2012 and up till now, his trial has not been concluded.

Superintendent of Police, Rohtas reported to this court vide letter no. 33 dated 13.01.2015 that out of seven proposed prosecution witnesses, four witnesses have already been examined and the case is pending for recording the depositions of remaining prosecution witnesses.

In view of the aforesaid facts and circumstances as well as submissions of the parties, prayer for bail of the petitioner in

Patna High Court Cr.Misc. No.50382 of 2014 (3) dt.31-03-2015 connection with Sessions trial no. 377/2013 arising out of Akorhigola P.S. case no.20/2012 pending in the court of Addl. Sessions Judge VI, Rohtas stands rejected.

However, trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to renew his prayer for bail before trial court itself. Let a copy of this order be sent to Superintendent of Police, Rohtas with direction to him to ensure presence of remaining prosecution witnesses before Addl. Sessions Judge VI, Rohtas within three months from the date of receipt/production of a copy of this order.
