JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to prosecution case itself, marriage of the petitioner has taken place in the year, 1998 with the deceased but the relation of the petitioner with the deceased was not cordial and the deceased had filed a case u/S 498A of the Indian Penal Code as well as a case of maintenance against the petitioner but it is obvious from the first information report that the deceased was residing at her matrimonial home.

Contention on behalf of the petitioner is that prior to institution of the present case, the mother of the petitioner lodged

Patna High Court Cr.Misc. No.3012 of 2016 (3) dt.24-02-2016 a Sanha No. 116 of 2015, disclosing the real cause of death of the deceased, who allegedly, consumed poison. The postmortem report of the deceased shows that no external injury was found on her person.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with K. Hat (Madhubani) P.S. Case No. 290 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Purnea.
