The petitioner seeks regular bail in connection with POCSO Case No. 195 of 2024 arising out of Mahila P.S. Case No. 65 of 2024 registered for the offence punishable under Sections 341, 323, 376, 313, 504, 506, 34 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act. 3.

As per prosecution case, the allegation against the petitioner is of kidnapping the victim. 4.

It has been submitted by the learned counsel for the petitioner that now the parties have got married and have also been blessed with a child.

Learned counsel further submits that the petitioner is innocent and has falsely been implicated in the case. The petitioner is in custody since 10.01.2026. 6.

Learned counsel for the informant has supported this fact as submitted by the learned counsel for the petitioner.

Considering the submissions made by the learned counsel for the petitioner, I am inclined to grant bail to the petitioner. Accordingly, this bail application is allowed. 8.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Biharsharif cum Exclusive Special Judge (POCSO) / concerned Court below, in connection with POCSO Case No.195 of 2024 arising out of Mahila P.S. Case No. 65 of 2024.

This is subject to the condition that at the accepting the bail bonds of the petitioner, the Court below shall verify from the victim as to whether the petitioner and the victim have got married and they have been blessed with a child or not. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
