This application for grant of regular bail arises out of Barachatti P.S. Case No. 147 of 2020 (POCSO Case No. 38/2020), disclosing offences punishable under Section 366A/34 of the Indian Penal Code and Section 4 of the POCSO Act. I find substance in the submission advanced on behalf of the petitioner that though there is allegation of kidnapping of the minor victim, there is no material to suggest that the victim was forcibly taken away. The petitioner is in custody since 24.03.2020.

Considering the above submission, this application is allowed.

Let the petitioner above-named be released on bail on
