2. The petitioner apprehends arrest in connection with Dumaria P.S. Case No. 28 of 2026 dated 05.03.2026, instituted for the offence punishable under Sections 126(2), 115(2), 117(1), 352, 351(2), 324(4), 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he assaulted the compounder on his head with iron rod due to which he sustained injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that as per the injury report, the injury sustained by the compounder is simple in nature caused

Patna High Court CR. MISC. No.32557 of 2026(2) dt.13-05-2026 2/2 by hard and blunt substance (Annexure-P/2). It is next submitted that there is no independent witness to the alleged occurrence. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Dumaria P.S. Case No. 28 of 2026, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, District- Gaya subject to condition as laid down under Section 482(2) of the B.N.S.S.
