====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-02-2021 Heard the learned counsel for the petitioner and the State.
The petitioner seeks bail in anticipation of his arrest in connection with Biraul P.S. Case No. 263 of 2019 dated 20.09.2019 instituted for the offences under Sections 341, 323, 325, 307, 379, 504 and 34 of the Indian Penal Code.
The petitioner and others are said to have assaulted the informant who had objected to the eve teasing of his cousin.
Though the informant has received injuries but a compromise petition has been filed indicating that the occurrence took place in some confusion. In fact, some persons of the neighbouring locality were trying to eve-tease another girl. The injuries suffered by the
Patna High Court CR. MISC. No.32458 of 2020(2) dt.17-02-2021 2/2 informant cannot specifically be attributed to the petitioner even though definite opinion also has been given about the nature of the injury.
Some of the other accused persons of this case have been granted anticipatory bail from the court below.
Regard being had to the circumstances noted above, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Biraul P.S. Case No. 263 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
While saying so, this Court has also taken note of the fact that the petitioner does not have criminal antecedents.
