JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but it would appear from perusal of the impugned order that his prayer was rejected by the learned court below on the ground that in course of investigation, complicity of the petitioner came in light vide paragraphs 15, 16 and 25 of the case diary and subsequently, the criminal antecedent of the petitioner was also found.

Learned counsel for the petitioner drew my attention towards paragraph-7 of the petition and submits that in course of investigation, some witnesses claimed to have seen the petitioner along with some others on the shop of the informant at the time of alleged occurrence but petitioner is in jail custody since 28.5.2015

Patna High Court Cr.Misc. No.1500 of 2016 (2) dt.15-01-2016 2/2 and up till now he has not been put on Test Identification Parade. It is further contended that so far as criminal antecedent of the petitioner is concerned, prior to institution of this case, petitioner was made accused in three cases and he has already been granted privilege of bail in two cases. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vimlendu Kumar, J.M.Ist Class, Begusarai in connection with Garhpura P.S.
