The petitioner is apprehending his arrest in connection with Kudhani P.S.Case No.458/17, corresponding to G.R.No.2783 of 2017 registered for offences punishable under Sections 420 and 379 of the Indian Penal Code. Allegation against the petitioner as per FIR is that the informant went to withdraw Rs.2,000/- from the ATM of his wife and at that time, a boy entered and he pressed some button and he returned, thereafter he came to know that Rs.14,000/- has been withdrawn by the petitioner.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and he is a student.

No.31083 of 2019(3) dt.22-07-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, he may surrender before the learned court below and prayer for regular bail, which will be considered on its own merit. With the aforesaid direction, this application is dismissed.
