2. The petitioner seeks regular bail in connection with Complaint Case No. 138 of 2020 for the offence registered under Sections 341, 323, 498A, 494, 504, 379, 34 of the I.P.C.

3. As per complaint case, the marriage of complainant was solemnized with the petitioner in the year 2007 and they have been blessed with a girl child. The allegation against the petitioner is that he has harassed and tortured the complainant and solemnized marriage with another girl in the year 2020 and on 15.02.2020 the accused persons assaulted the complainant and ousted her from the house with her daughter.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The marriage was solemnized between the parties in the year 2007 and the allegation of harassment and torture by the petitioner to the complainant was made in the year 2020. In fact the complainant herself living separately from the petitioner since last 10 years and solemnized another marriage and from their wedlock she has a son. Petitioner has got no criminal antecedent and he is in custody since 10.02.2024. He undertakes to cooperate in the trial of the case. 5.

Learned APP for the State opposes the prayer for grant of regular bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Complaint Case No. 138 of 2020.
