Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner happens to be own uncle of the deceased and allegedly, while petitioner was assaulting his own father with butt of loaded gun, deceased intervened into scuffle and after being annoyed petitioner opened fire on the deceased as a result of which deceased, having sustained firearm injury, fell down and died then and there. The contention on behalf of the petitioner is that scuffle was going on between the parties and accidentally, gun got fired causing firearm injury to the deceased.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Jamhore P.S. Case no. 66/2015 pending in the court of Chief Judicial Magistrate,

Patna High Court Cr.Misc. No.1461 of 2016 (2) dt.14-01-2016 Aurangabad stands rejected.
