====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-01-2019 Heard the learned counsel for the petitioners and the State.

The petitioners seek bail in anticipation of their arrest in connection with Sangrampur P.S. Case No. 134 of 2018 dated 10.08.2018 instituted for the offences under Sections 363, 366A, 504 and 506 of the Indian Penal Code.

The 13 year old daughter of the informant is said to have been taken away for immoral purposes by Mithilesh Giri who is the son of the petitioners and one Minchu Paswan. When the informant went to the house of petitioner no. 1 to enquire about his daughter, he was misbehaved with.

Learned counsel appearing for the petitioners

Patna High Court Cr.Misc. No.1967 of 2019(2) dt.15-01-2019 2/2 has drawn the attention of this Court to the 164 statement given by the daughter of the informant who has raised allegations against Mithilesh Giri only and has stated nothing about the petitioners. The petitioners, it has been submitted, have no control over their son and they have not participated in the occurrence. For the aforestated facts and also taking into account the age of the petitioners and that they are not accused in any other case up till now, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sangrampur P.S. Case No. 134 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
