The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 448, 504, 354, 506, 379/34 of the Indian Penal Code.
As per F.I.R., on 12.12.2021, petitioner alongwith other co-accused came at the door of the informant and started abusing and assaulting informant and his family members. Petitioner is alleged to have assaulted with lathi causing injury on the head of informant's brother Bhupendra Yadav. It is further alleged that this petitioner also snatched gold chain and ear rings from the informant's wife.
It is submitted on behalf of petitioner that due to land dispute between the parties, alleged occurrence took place.

Allegation of snatching gold chain and ear-rings is ornamental only with a view to make the offence grave. In fact, an attempt was made by the informant side to grab the disputed land, which was objected, as a result of which, simple Maarpit took place between the parties. Injury caused by the petitioner is simple in nature. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, District - Madhepura in connection with Gwalpara P.S. Case No. 197 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
