The petitioner apprehends his arrest in connection with Excise Case No. 153C2 of 2018 registered for the offence punishable under Section 30 (a) of Bihar Prohibition & Excise Act, 2017.
Learned counsel for the petitioner submits that there is no recovery of liquor from the conscious possession of the petitioner. It is submitted that the seized article of 171 liters foreign wine have been recovered from one Wagon R Car bearing registration no. HR56A-9690 at village Sherper Mushari. It is submitted that the petitioner has no criminal antecedent and there is nothing to connect him with the present case but his name has been falsely implicated in connection with this case.
Patna High Court Cr.Misc. No.2095 of 2019(2) dt.21-01-2019 2/2 No one appears on behalf of the State to oppose this application.
In the given facts and circumstance of the case, let the petitioner above named surrender in the court below within four weeks from today and pray for regular bail. In case such an application for regular bail is filed, considering the submission of petitioner that he is not the owner of the vehicle and the liquor has not been recovered from his house, this Court would direct the court below to consider his prayer for regular bail on the same day. The court below shall consider the prayer on the basis of materials including the aforesaid submissions and pass an appropriate order thereon.
This application stands disposed off.
