JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-12-2020 Heard Mr. Sharda Nand Mishra, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Balrampur P.S. Case No. 54 of 2020 instituted for the offences under Sections 341, 323, 324, 379, 307, 354(A), 504 and 34 of the Indian Penal Code.

It has been alleged in the First Information Report that on protest by the informant and his family members against the action of the accused persons in appropriating the Government land which is meant for egress of water, an occurrence took place in which two of the persons from the

Patna High Court CR. MISC. No.33465 of 2020(2) dt.15-12-2020 2/2 side of the informant were injured.

The petitioner though is named in the F.I.R. but nothing specific has been alleged against him. He is in custody since 19.04.2020.

Regard being had to the nature of accusation and the period of custody of the petitioner and also taking into account his clean antecedents, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Balrampur P.S.
