The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.

Prosecution case is that other accused persons assaulted the informant and this petitioner is alleged to have conspired with other accused persons and got him assaulted by them.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only with a view to pressurize the petitioner and his family members to compromise Tajpur Police Station Case No. 405 of 2014 filed by her. Petitioner is only alleged to be conspirator

Patna High Court CR. MISC. No.43580 of 2021(3) dt.21-06-2022 2/2 and no overt act has been alleged against her. Petitioner is a lady and has got no criminal antecedent.

Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 16 cum Sub Judge 17, Vaishali at Hajipur in Baligao Police Station Case No. 20/2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
