JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 This is an application for grant of anticipatory bail in connection with Paliganj P.S. Case No. 265 of 2018, disclosing offences under Sections 401, 419, 420 of the Indian Penal Code and Sections 27(C), 27(D), 28(A), 28(B) of the Drugs and Cosmetics Act.

Allegation against the petitioner is of selling the drugs without having valid license.

At the very outset, learned A.P.P. for the State has pointed out that the petitioner was on police bail under Section 41(A) of Cr.P.C. and as such, he should move before the court below for grant of regular bail.

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a

Patna High Court Cr.Misc. No.1977 of 2019(3) dt.21-02-2019 2/2 direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of the order of this Court and pray for regular bail, which shall be considered on the ground that earlier the petitioner was granted police bail under Section 41(A) of Cr.P.C. and did not misuse the same, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
