JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Sections 394/411 of the Indian Penal Code and later on, Section 37(b) (c) of Bihar Excise and Prohibition Act, 2016 was also added.

Petitioner is not named in the first information report but it would appear from perusal of the impugned order that in course of investigation, he was arrested on the basis of suspicion and some articles including one knife was recovered from his possession. However, there is nothing to show that seized knife was used in the alleged crime.

No.33865 of 2019(2) dt.23-05-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 9061 of 2018 arising out of Kadamkuan P.S. Case No. 564 of 2018.
