Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

The petitioner seeks bail in connection with Sessions Trial No.238 of 2019 arising out of Manpur P.S. case No.09 of 2018 registered under Sections 304(B), 201/34 of the Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner happens to be the husband of the deceased.

A report was called for from the Trial Court. It has

Patna High Court CR. MISC. No.18885 of 2021(3) dt.29-09-2021 2/2 been reported that out of seven prosecution witnesses, five prosecution witnesses have already been examined. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2018 and he has remained in custody for approximately three and half years and there is no chance of the trial being concluded in near future. Considering the facts and circumstances of the case, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned IX Additional District and Sessions Judge, Bettiah, West Champaran in connection with Sessions Trial No.238 of 2019 arising out of Manpur P.S. case No.09 of 2018. The petitioner shall be present in the trial court on each and every date and co-operate during the trial. If the petitioner does not appear on two consecutive dates in the trial court, the trial court itself is at liberty to cancel the bail bond of the petitioner.
