2. The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 209 of 2023 for the offences registered under Sections 341, 323, 325, 307 and 379/34 of the Indian Penal Code.
3. As per the prosecution case, on instigation of the petitioner his son co-accused Balindra Rai assaulted the informant with Farsa on his head and the petitioner also assaulted him with sword due to which he sustained injury on his hand.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to previous enmity. He further submits that the alleged
Patna High Court CR. MISC. No.38970 of 2024(2) dt.17-05-2024 2/2 injury caused by the petitioner is simple in nature. He is in custody since 16.03.2024. It is further submitted that similarly situated co-accused, namely Balindra Rai @ Balindra Roy has been granted bail by a Co-ordinate Bench of this Court, vide order dated 24.01.2024 passed in Cr. Misc. No. 2657 of 2024. Petitioner has no criminal antecedent.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate I, East Champaran (Motihari)/ concerned Court in connection with Rajepur P.S. Case No. 209 of 2023.
