JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 The petitioners apprehend their arrest in connection with Complaint Case No. 1803 of 2015 registered under Sections 323,380 and 498A of the Indian penal Code and 4 of the Dowry Prohibition Act.

Allegation against the petitioners is of subjecting to O.P.No. 2 to cruelty with respect to demand of Rs. 2 lacs and motorcycle.

Submission of learned counsel for the petitioners is that whole allegation is false and concocted and petitioner no. 1 is ready to keep his wife but she is not ready to reside with him and petitioner no. 2 is her father-in-law.

Patna High Court CR. MISC. No.2041 of 2019(4) dt.26-03-2019 2/2 Heard learned APP as well as learned counsel for the O.P.No. 2. They have opposed the prayer for anticipatory bail stating that O.P.No. 2 has been subjected to cruelty with respect to demand hence they do not deserve bail.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Banka in connection with Complaint Case No. 1803 of 2015; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition to co-operate in disposal of the trial.
