Petitioner is not named in the first information report and the informant claimed that it was one of the F.I.R named accused Kaushal Yadav, who had fired upon the deceased. It appears from perusal of the impugned order that the petitioner has been dragged in this case only on the basis of suspicion as well as criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Purnea in connection with Barhara
