ANJANA MISHRA ORAL ORDER 25-05-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are in custody since 3.2.2015 in connection with Falka P.S. Case No.24 of 2015 registered for the offences under Sections 420 and 201 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
The petitioners are Driver and Khalasi of the mini truck. It is alleged that the said truck was loaded with fake fertilizer by one Sudharshan, which was apprehended by the police. Learned counsel for the petitioners submits that the petitioners have been in custody since 3.2.2015, have no criminal antecedents and being Driver and Khalasi of the said mini truck
Patna High Court Cr.Misc. No.10948 of 2015 (3) dt.25-05-2015 2/2 and have nothing to do with either genuine or fake fertilizer loaded on any vehicle.
Considering the aforementioned submissions, let the above named petitioners be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Katihar, District-Katihar, in connection with Falka P.S. Case No.24 of 2015.
