2. The petitioner seeks bail in connection with Maniyari PS Case No.239 of 2024 dated 01.10.2024, instituted for the offence punishable under Sections 80/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that marriage of the daughter of the informant was performed with the petitioner on 26.04.2023 accordingly to Hindu customs and rites. After marriage, the informant's daughter went to her matrimonial home and lived there happily for two months but thereafter her

No.33613 of 2025(3) dt.06-08-2025 2/3 husband and in-laws started demanding a Bolero vehicle in dowry and she was subjected to cruelty and harassment due to non-fulfillment of the same. The informant tried to pacify the matter, but the accused persons were adamant for their demand. On 30.09.2024, the informant came to know that his daughter has hanged herself but when the informant reached the matrimonial home of his daughter, he came to know that the petitioner and other in-laws have committed of his daughter due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that on the alleged date of occurrence the petitioner was on duty at Indore and this fact finds place in paragraph no.3 of the case diary. In paragraph no.3 of the case diary, statement of the informant has been recorded who supports the case of the petitioner that he was not present at the time of occurrence. Learned counsel for the petitioner further submits that the petitioner was working in Abhinav Infrabuild Pvt. Ltd., Indore, Madhya Pradesh, and it would be apparent from the attendance report of his duty with effect from 1st to 29th September, 2024, (Annexure-2) that he was present on the duty on the alleged date of occurrence. Lastly, it is submitted that the petitioner is in custody since 21.02.2025 having clean antecedents.

5. Learned APP as well as learned counsel for the informant has opposed the prayer for bail. Learned counsel for the informant submits that the petitioner is the husband of the deceased. The trial has started and one witness has also been examined in the case.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VIII, West, Muzaffarpur, in Maniyari PS Case No.239 of 2024.
7. The application stands allowed.
