Petitioner is languishing in custody since 29.09.2014 in a case registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code. The prosecution case is that the younger brother of the informant Pintu Kumar went to Ara market on 11.09.2014 at 11.00 A.M. and thereafter he went traceless. It is alleged against the petitioner that after few days of the incident he several times came to the house of the informant and inquired about the younger brother of the informant which creates suspicion.

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been

Patna High Court Cr.Misc. No.12261 of 2015 (3) dt.29-06-2015 levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Learned counsel for the informant failed to suggest anything specific against the petitioner except the suspicion during inquiry made by him.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case no. 545 of 2014.
