JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Hussainganj P.S. Case No. 164 of 2017, disclosing offences under Sections 420, 419, 406, 467, 468, 471 and 34 of the Indian Penal Code.

It appears that initially the complaint petition was filed by the complainant/informant before the Chief Judicial Magistrate, Siwan, which was subsequently sent to the concerned police station under Section 156(3) for registration of F.I.R.

Allegation, as per complaint petition is that petitioner and his son has taken 4,50,000/- for providing job to the informant outside the country and he was assured that he would get 300 Dollars per month, however, he was sent to the abroad with forged VISA and was asked to work on a damaged ship but not a single farthing was paid to him. Thereafter, the

Patna High Court Cr.Misc. No.2051 of 2019(2) dt.16-01-2019 2/2 informant came back and demanded his money from the petitioner, which the petitioner refused to pay and threatened to kill him.

Submission of learned counsel for the petitioner is that the complaint petition of the complainant/informant itself shows that he was sent to the abroad by the petitioner and in fact, the petitioner could not work there and he himself returned back and, thereafter, lodged this present false and concocted case.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No. 164 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U
