JUSTICE GOPAL PRASAD ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has been arrested in connection with Barahiya P.S. Case No. 19 of 2014 registered under Sections 364, 302, 379 and 120(B)/34 of Indian Penal Code.

The petitioner has not been named in the First Information Report. There is no recovery from the possession of the petitioner and only material against the petitioner is that his name finds place on confessional statement of the co-accused. It is further submitted that except this case petitioner has been made accused in another case for offence under Sections 399 and 402 of the Indian Penal Code as well as Section 25(1-B)A, 26 and 35 of the Arms Act. The petitioner is in jail custody since 11.07.2014. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P. S. Case No. 19 of 2014.
