JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of this petitioner came in statement of one Subhash Paswan, who made statement under section 164 of the Cr.P.C when looted mobile set was recovered from possession of his son. The aforesaid Subhash Paswan disclosed that his son had purchased the seized mobile from the petitioner. The above stated Subhash Paswan is none else but the own nephew of the petitioner and the stand of the petitioner is that being agnates the aforesaid Subhash Paswan has inimical relation with the petitioner and with an intent to save skin of his son, he implicated the petitioner. Considering the aforesaid facts and circumstances as

No.11019 of 2015 (2) dt.19-03-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Mansi Rail P.S.Case No. 01 of 2014.
