The petitioner is apprehending his arrest in connection with Sangrampur P.S.Case nO.77 of 2018 dated 14.5.2018 registered for offences punishable under Sections 498A, 504 and 506 of the Indian Penal Code and Section 3 & 4 of the Dowry Prohibition Act, 1961.

This case is under Section 498A of the IPC and the petitioner happens to be husband .

At the very outset it is submitted by the learned counsel for the petitioner that he is ready to keep her with dignity and care. The O.P. no.2 has appeared by filing Vakalatnama . Submission of the learned counsel for the O.P.no.2 is that she is ready to reside with the petitioner unless any cruelty

Having heard both sides and in view of the fact this application is disposed of with direction to the petitioner to surrender before the learned court below on 27.3.2019 by filing an application that he is ready to keep O.P. no.2 and on that day O.P.no.2 shall also be present in the court below and thereafter if the court finds that the petitioner is ready to keep her with dignity and care , he shall released the petitioner on provisional bail for the period of six months to the satisfaction of the learned court below itself and the learned court below shall watch the conduct of both the parties for the period of six months by calling them in the first week of each month and once being satisfied with the conduct of both the parties and the matrimonial relation, the learned court below shall confirm the bail bond of the petitioner otherwise he is free to pass any other order including cancellation of the bail bond of the petitioner.
