The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code and Sections 25(1-b)a/35 of the Arms Act.

Allegation is that on the point of pistol three unknown miscreants looted away Rs.42,600/- from the sales room of Muskan petrol pump.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.01.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come on the basis of

Patna High Court CR. MISC. No.31551 of 2019(2) dt.03-07-2019 2/2 confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. case No.25 of 2019.
