The petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 97 of 2020 dated 25.02.2020 instituted for the offences under Sections 30(A)/32(ii)/34(ii)/38(ii)/41(i) of Bihar Prohibition and Excise Act, 2018.

It has been submitted on behalf of the petitioner that 600 litres of liquor has been recovered from the cowshed alleged to be belonging to the petitioner but it is an open space which is accessible to all. It has also been submitted that the petitioner does not have criminal antecedents.

However, considering the factum of recovery of liquor from the cattle shed of the petitioner, I am not

The prayer for anticipatory bail is rejected. In case the petitioner surrenders before the court below and seeks bail, his application shall be considered on its own merits without being prejudiced by the fact that the present petition has not been entertained.
