The petitioner seeks bail in a case registered under Section 420 and other sections of the Indian Penal Code. The informant made allegation that Harendra Pandey and Rajendra Pandey, who were the Managing Directors of the Company, took money from the informant and others for installing a mobile tower but neither did they install the mobile tower nor did they return the money.

Learned counsel for the petitioner submits that the petitioner was the Project Manager of the Company. There is no allegation against the petitioner that he took money from any person. Similarly situated co-accused Dharambir Ram has already been enlarged on bail vide order passed in Cr. Misc. No. 5650/2015.
