The petitioner seeks bail in Makhdumpur P.S. Case No. 80 of 2019, instituted for the offence under Section(s) 341, 342, 323, 379, 504 and 506/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 14.3.2019 having clean antecedent. The informant is practicing lawyer in Civil Court, Jehanabad. It is alleged in the written report that on the date of occurrence while the informant was returning to his house by Motorcycle from Civil Court, Jehanabad and reached East to Jal Sagar Bridge, Bimal Kumar, Joni Sharma (petitioner) and two unknown persons surrounded him. It is further alleged that

Patna High Court CR. MISC. No.32441 of 2019(2) dt.26-06-2019 2/2 co-acused Bimal Kumar pointed pistol on his temple (Kanpatti) and snatched his Samsung Mobile worth Rs.1,800/-. Allegation against petitioner is that he snatched Rs.3,500/-, Aadhar Card, Pan Card and other documents.

Counsel for the petitioner submits that petitioner has been made accused only because of enmity. There is no recovery of any incriminating article from possession of the petitioner.

Petitioner is in custody since 14.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad, in connection with Makhdumpur P.S. Case No. 80 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
