Petitioner is languishing in custody since 11.06.2012 in a case registered for the offences punishable under Sections 20, 22, 23, 24 of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that the informant has received information that some persons were carrying ganja from Nepal, but the accused persons seeing the police personnel after throwing 80 Kg. ganja escaped from the scene.

It appears from the report of the Superintendent of Police, East Champaran, Motihari at Flag-D dated 17.06.2016 that out of 11 witnesses 08 have

Patna High Court Cr.Misc. No.49035 of 2014 (6) dt.01-08-2016 already been examined and prosecution is taking steps for examination of the remaining witnesses.

Considering the present stage of trial, this Court is not inclined to interfere.

Accordingly, the application is dismissed.
